Topic: Non-Competes and FTC Rule

On April 23, 2024, the Federal Trade Commission (FTC) issued a Final Rule to ban covenants not to compete nationwide. This Rule would significantly limit the post-termination protections currently available to many employers. Within days of the FTC announcement, lawsuits were filed challenging the legality of the Final Rule. In this webinar, we will cover the scope and future of the Final Rule, as well as other post-employment restrictions available to employers. The topics include the following: 

• The future of the Final Rule and pending lawsuits
• State laws that prevent or restrict covenants not to compete
• What actions, if any should employers take regarding existing non-competes
• Factors to consider in drafting restrictive covenants, including which employees should execute them, and the scope of the covenant
• The legitimate business needs of the employer: Do you need a non-compete?
• Covenants not to solicit customers and how to draft these restrictive covenants
• Covenants not to disclose confidential information – protecting information beyond trade secrets
