Tom is a Shareholder and former Co-Chair of Maynard Cooper's Litigation Practice.
He focuses his practice on complex litigation matters, including class actions, commercial business litigation, financial services litigation, antitrust, intellectual property and trade secrets litigation, Lanham Act litigation, mergers & acquisitions litigation, and scientific research misconduct litigation. Tom also has extensive experience defending multi-district litigation, consolidated class actions, and mass tort litigation.
Tom has represented clients in matters pending in Alabama, Arkansas, California, the District of Columbia, Florida, Georgia, Illinois, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, New Jersey, North Carolina, Pennsylvania, Tennessee, Texas, Utah, and West Virginia. He has tried numerous jury trials, bench trials, and arbitrations in various courts and venues in Alabama, Texas, and the District of Columbia. His appellate work includes handling appeals in the Third, Fourth, Fifth, Sixth, Eighth, and Eleventh Circuits, The Alabama Supreme Court and The Florida District Court of Appeals. He served as court-appointed Liaison Counsel for a defendant group in the FEMA Formaldehyde MDL pending in the Eastern District of Louisiana.

Tom's reputation as a skilled litigator has been widely recognized by numerous legal industry publications and organizations. He is named by Chambers USA: America’s Leading Lawyers for Business as a Leading Individual in the area of Commercial Litigation, and Super Lawyers named him to the 2016 Mid-South Super Lawyers for Business Litigation and the 2015 "Top 50 Alabama Super Lawyers". Best Lawyers® named Tom "Lawyer of the Year" in 2014 and again in 2017 for his abilities, professionalism and integrity in the area of Litigation: Mergers and Acquisitions in Birmingham, a distinction given to only one attorney in each geographic region. In 2016, Tom was selected as Best Lawyers® "Lawyer of the Year" in the area of Litigation: Intellectual Property in Birmingham. Law360.com named Tom a "Legal Lion" in 2014.
Notably, in 2015, Tom served as co-counsel defending McWane, Inc., a manufacturer of ductile iron pipe, in an enforcement proceeding before the FTC. The eight-week administrative trial involved over 2,000 exhibits and 53 witnesses, culminating in a 464-page decision – possibly the longest FTC decision in history. Ultimately, Maynard Cooper convinced the FTC to rule against its own complaint, something the FTC had not done in twenty years.
Using his wealth of class action experience, Tom organized and Co-Chaired for several years the country's premier class action seminar, "The Future of Class Action Litigation In America." The panel presentations were held in Boston and Washington, D.C. and featured some of the leading class action practitioners from both the defense and the plaintiffs' bars as well as the country's foremost academics. Senators Orrin Hatch (Utah) and Tom Carper (Delaware) served as keynote speakers. Tom also served on the Editorial Board and co-authored Chapter 21: "Arbitrations & Class Actions" for the American Bar Association's two-volume treatise A Practitioner's Guide to Class Actions, published in 2017, 2012, and 2010.
