This has been a season of both political and judicial surprises. Late yesterday, Judge Amos Mazzant, III of the U.S. District Court for the Eastern District of Texas issued a nationwide preliminary injunction against the U.S. Department of Labor's (“DOL”) implementation of the final Fair Labor Standards Act (“FLSA”) white collar exemption rules, which were scheduled to take effect December 1, 2016. We previously reported on the possibility of such a ruling here.
On November 16, 2016, United States District Court Judge Sam R. Cummings held that the Department of Labor’s Persuader Advice Exemption Rule (“Persuader Rule”) is unlawful, and he issued a nationwide permanent injunction barring its implementation and enforcement. In the Order arising from the United States District Court for the Northern District of Texas, Judge Cummings also granted summary judgment in favor of the several states and business groups who challenged the Persuader Rule and denied the United States Department of Labor’s (“DOL”) cross-motion for summary judgment.
